1. About us

This website is operated by MASSOULS, a sole trader business based in Queensland, Australia (ABN 22 331 202 055).

Throughout this site, the terms "we", "us" and "our" refer to MASSOULS. When we say "you", we mean the person visiting this site or placing an order.

You can reach us at contact@massouls.com. We reply within 24 hours.

2. Agreeing to these terms

By browsing this site or placing an order, you agree to these terms. If you do not agree with any part of them, please do not use the site.

These terms sit alongside our Privacy Policy, Refund Policy and Shipping Policy. Together they form the whole agreement between us.

3. Who can order

You must be at least 18 years old to place an order, or have the permission of a parent or guardian.

You agree to give accurate and complete information when you order. If your delivery address is wrong or incomplete, we may not be able to deliver, and we cannot cover the cost of a reshipment in that case.

4. Our products

Every product page describes the fabric, weight, fit and construction of the garment. We keep those descriptions accurate and we update them if a specification changes.

Colours on screen are not exact. Screens vary, and so does the way light falls on fabric. We photograph our garments as honestly as we can, but a small difference between the screen and the garment in your hands is normal and is not a fault.

Our garments are made to order. That means we do not hold large amounts of stock, and each piece is produced after you buy it.

5. Prices and payment

All prices are shown in Australian dollars (AUD).

We may change prices at any time, but a change never affects an order you have already placed and paid for.

We accept the payment methods shown at checkout. Payments are processed by third party providers, and their own terms apply to how they handle your payment. We never see or store your full card details.

If a product is listed at the wrong price because of an obvious error, we may cancel the order and refund you in full. We will tell you before we do that.

6. Orders

Your order is an offer to buy. We accept it when we send you a confirmation email.

We may refuse or cancel an order. That happens rarely, and only for good reason: a pricing error, a payment we cannot verify, an address we cannot ship to, or an order that looks fraudulent. If we cancel, you get a full refund.

Once production has started we may not be able to change or cancel an order. Email us as soon as possible and we will do what we can.

7. Delivery

Delivery times, costs and the areas we ship to are set out in our Shipping Policy.

The times we quote are estimates, not guarantees. Once a parcel is with the carrier, the carrier controls it. We will always help you chase a delayed or lost parcel, and where a parcel is lost in transit we will replace it or refund you.

Risk in the goods passes to you on delivery.

8. Returns and refunds

Our Refund Policy is part of these terms. In short: you have 30 days from delivery to return or exchange an item for any reason, provided it is unworn, unwashed and in original condition with tags attached.

9. Your rights under Australian Consumer Law

Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law.

Our goods come with guarantees that cannot be excluded. You are entitled to a replacement or refund for a major failure, and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if they are not of acceptable quality and the failure does not amount to a major failure.

These rights are not limited by the 30 day window in our Refund Policy. That window is something we offer on top of them.

10. Our brand and content

The MASSOULS name, logo, designs, photography, text and layout on this site belong to us or are used with permission. They are protected by copyright and trade mark law.

You may not copy, reproduce or use them commercially without our written permission. Buying a garment gives you the garment. It does not give you a licence to our designs.

11. Using this site

You agree not to use this site to break the law, to interfere with how it works, to gain access you are not entitled to, or to collect data from it by automated means.

We may suspend access to anyone who does.

12. Content you send us

If you send us a review, a photo, a comment or a suggestion, you keep ownership of it. You give us permission to use, publish and edit it in connection with our business, without payment.

Only send us content that is yours to send.

13. Third party services

This site runs on Shopify and uses other third party services, including payment providers, delivery carriers and analytics tools. Those services have their own terms and privacy practices, and we are not responsible for how they operate.

Links to other websites are provided for convenience. We do not control them and we are not responsible for their content.

14. Our contribution to ChildFund Australia

Every purchase from MASSOULS supports ChildFund Australia, which works with children in Asia, Africa and the Pacific.

That contribution is made by us, from our own revenue. It is not an additional charge to you, and buying from us is not a donation by you to ChildFund Australia. You are buying a garment from us.

We are not affiliated with ChildFund Australia beyond being a supporter, and nothing on this site should be read as ChildFund Australia endorsing our products.

15. Availability of the site

We do our best to keep the site running, but we do not promise it will always be available or free of errors. We may change, suspend or withdraw any part of it, including any product, at any time.

16. Liability

Subject to section 9, and to the extent the law allows:

  • we are not liable for indirect or consequential loss arising from your use of this site or from any product you buy; and
  • where we are liable, our liability is limited to the amount you paid for the product concerned.

Nothing here limits our liability for anything that cannot be limited by law, including fraud, death or personal injury caused by our negligence.

17. Events outside our control

We are not responsible for delays or failures caused by events beyond our reasonable control. That includes natural disasters, industrial action, carrier disruption, supply failures, and interruptions to power or telecommunications.

Where such an event affects your order, we will contact you and, if the delay is significant, offer you the choice of waiting or receiving a full refund.

18. Changes to these terms

We may update these terms. The current version is always the one published on this page, and the date at the top tells you when it last changed.

Changes apply from the moment they are published. They do not affect orders you have already placed.

19. Governing law

These terms are governed by the laws of Queensland, Australia. You and we submit to the non-exclusive jurisdiction of the courts of that state.
